Reporting obligation

Before contracting any activity, the client is obliged to inform about a possible pregnancy, recent anxiety, dizziness, vertigo, allergies, cardiovascular diseases, or any other disease that could have relevance in the normal development of the activity. Likewise, he/she undertakes not to be under the influence of alcohol, drugs, narcotics, or any other medication that could affect his/her normal physical or mental capacities.

Reservations

Bookings are considered to have been made when the client receives a confirmation email or WhatsApp message from Abubila. In some cases, the payment of a deposit is required to validate the booking.

At the moment of formalizing the payment of the reservation, the client and all persons registered within the framework of this reservation will be subject to the general and particular conditions of contract of Abubila.

TANDEM FLIGHTS

The pilot is the commander of the tandem glider, and the passenger agrees to follow his instructions. The pilot decides whether and how mobile phones and cameras can be carried.

The passenger certifies that he/she does not suffer from any health problems (of a mental or physical nature) that could have an impact on the safety of a tandem paragliding flight.

The passenger is aware that tandem paragliding involves risks. The risk of a sudden and unpredictable influence of the wind cannot be excluded. MSDEPORTES LANZAROTE S.L. has taken out liability insurance. In case of bodily injury and material damage suffered by the passenger during a tandem paragliding flight, the liability of MSDEPORTES LANZAROTE S.L. is limited to the conditions of this insurance.

Cancellation

In accordance with the conditions indicated below, the client may withdraw from the services requested or contracted, having the right to a refund of all or part of the amounts paid to Abubila. Abubila reserves the right to retain administration fees, which may be up to the amount of the deposit paid in advance.

  1. 100% refund of the total amount of the activity if the cancellation is made 4 days before the start date of the activity.
  2. Refund of 50% of the total amount of the activity if the cancellation is made between 3 or 2 days before the start date of the activity.
  3. In the event of withdrawal less than 48 hours before the start of the activity, the full amount is due and must be paid in full by the client. In exceptional circumstances, a refund may be considered by Abubila at its discretion.

Abubila may cancel the activity due to force majeure, abnormal and unforeseeable circumstances such as adverse weather conditions that endanger the development of the activity. The client will have the right to change the date of the activity or to a full refund of the amounts paid.

fly-guide

The FLY-GUIDE activity is reserved for autonomous paragliding pilots. The paraglider pilot must hold a valid paragliding licence and insurance covering this activity.

Paraglider pilots fly under their own responsibility. Abubila accepts no responsibility for accidents or damage to equipment during the activity.

CANCELLATION

In accordance with the conditions indicated below, the client may withdraw from the services requested or contracted, having the right to a refund of all or part of the amounts paid to Abubila. Abubila reserves the right to retain administration fees, which may be up to the amount of the deposit paid in advance.

  1. 100% refund of the total cost of the activity if the cancellation is made 30 days before the start date of the activity.
  2. In the event of cancellation within 30 days before the start of the activity, the full amount is due and must be paid in full by the client. In exceptional circumstances a refund may be considered by Abubila at its discretion.

Abubila may cancel the activity due to force majeure or abnormal and unforeseeable circumstances. Abubila may also cancel the activity if the number of participants is insufficient. The client will have the right to change the date of the activity or to receive a full refund of the sums paid.

INFRASTRUCTURE AND EQUIPMENT

The customer undertakes to respect the equipment and infrastructure made available. He must takecare of the equipment and infrastructure. The customer assumes all costs of repair or replacement of the equipment in case of damage.

Other sports activities

The client carries out his sporting activity, paragliding, cycling, surfing, or others at his own risk. MSDEPORTES LANZAROTE S.L. declines all responsibility in case of accident.

IMAGE RIGHTS

By contracting the services of Abubila, the client agrees that his/her image and voice may be recorded and used for private or public publication and broadcasting.

The client assigns to Abubila (as well as its affiliates and other third parties), the rights of partial or complete exploitation of his/her image(s) (videos, photos) and sound recording(s), including their reproduction, modification, adaptation, broadcasting to public and social media of any kind, without limitations or restrictions.

In case the client does not wish to appear in the digital media, Abubila commits to remove the image within a reasonable time.

Applicable law and jurisdiction

In the event of any dispute arising from the tandem flight, users from the USA and Canada explicitly waive any jurisdiction in the USA or Canada and are aware that neither MSDEPORTES LANZAROTE S.L. nor the pilot will accept jurisdiction in the USA or Canada.

The relationship between the client and MSDEPORTES LANZAROTE S.L. is governed solely by the regulations in force and applicable being competent for the resolution of conflicts the jurisdictional bodies of the territory where MSDEPORTES LANZAROTE S.L. has its registered office. The original version of this paper is the Spanish language and is the reference for any legal procedure.
